The Trump administration has reversed guidance from the Biden administration concerning the Emergency Medical Treatment and Active Labor Act (EMTALA), which had implications for emergency room doctors and abortion procedures. The rescinded guidance was challenged in a lawsuit regarding Idaho's Defense of Life Act, which reached the Supreme Court last year before being dropped by Attorney General Pam Bondi in March.
EMTALA, established in the 1980s, mandates that emergency rooms provide stabilizing care to patients regardless of their ability to pay. While EMTALA does not mention abortion specifically, it requires care for both pregnant women and their "unborn child."

Ingrid Skop, M.D., FACOG, vice president and director of medical affairs at Charlotte Lozier Institute and an ob-gyn in Texas, noted that many states have pro-life laws allowing women to receive necessary care during medical emergencies such as miscarriages or ectopic pregnancies.
