The State of Louisiana, represented by Attorney General Liz Murrill, along with abortion drug coercion survivor Rosalie Markezich, has requested that a federal district court halt the Biden administration’s rule allowing mail-order access to abortion drugs. The plaintiffs argue that the U.S. Food and Drug Administration’s policy endangers women and prevents states like Louisiana from enforcing their own pro-life laws.
Rosalie Markezich shared her concerns about how the current rule can facilitate coercion and abuse against women who do not wish to terminate their pregnancies. In response to similar incidents, Louisiana passed the Catherine and Josephine Herring Act last year, which criminalizes poisoning women with abortion drugs. This law was inspired by the case of Catherine Herring and her daughter, who survived multiple attempts at being poisoned with such medication.
In correspondence sent last week to Senator Bill Cassidy (R-LA), FDA Commissioner Marty Makary acknowledged that hundreds of women have needed blood transfusions after using abortion drugs. However, he did not specify when or if the FDA would end the mail-order drug policy or complete its ongoing safety review of mifepristone.
Marjorie Dannenfelser, president of SBA Pro-Life America, expressed support for Louisiana’s legal action. She stated:
"Peer-reviewed research found three quarters of ER visits within 30 days after abortion drug use were coded as severe or critical. Two separate, independent studies also found more than 1 in 10 women experience at least one severe adverse event. Complications can include hemorrhaging, infection, sepsis, and even death."
