The groups argue that the proposed constitutional amendment includes multiple amendments that are not closely related and have not been historically treated as a single subject. They express concern that Montana voters will not fully understand what they are voting for if the proposal moves forward, as the text of the amendment is filled with legally deficient and confusing language.
This is not an isolated case, as attorneys general in other states are also taking action to challenge deceptive ballot measures. In Arkansas, Attorney General Tim Griffin required activists to rewrite their proposed language due to its misleading nature. Similarly, Florida's Attorney General Ashley Moody has challenged a proposed abortion amendment in her state, with the Supreme Court hearing oral arguments on February 7. South Dakota's Attorney General Marty Jackley has also admonished abortion activists for deceiving voters to sign petitions.
