The Archdiocese of New York has responded to the April 23, 2024, decision by the New York First Department Appellate Court that allows Chubb’s declaratory judgment action against the Archdiocese to proceed. The court's decision permits the lawsuit to move forward but does not constitute a judicial determination regarding Chubb’s allegations.
Despite the ongoing litigation, Chubb continues to defend the Archdiocese and its additional insured organizations in Child Victims Act (CVA) lawsuits covered under its insurance policies. Chubb is obligated to maintain this defense while the litigation is pending. Additionally, under these policies purchased by the Archdiocese, Chubb is required to indemnify both the Archdiocese and its additionally insured organizations for CVA claims—a responsibility that Chubb seeks to avoid through what the Archdiocese describes as a "specious lawsuit."
Chubb has also alleged that the Archdiocese has failed to provide requested information concerning these lawsuits. In response, the Archdiocese asserts that it has provided and will continue to provide all necessary information as stipulated by Chubb’s insurance policies. The Archdiocese refutes any claims of non-cooperation as "ridiculous" and "demonstrably incorrect."
The Archdiocese emphasizes its commitment to compensating victim-survivors with valid claims, regardless of what it perceives as Chubb's attempts to evade its legal, moral, and contractual obligations. According to the statement from the Archdiocese: "Chubb is the obstacle standing between a just resolution for victim-survivors and the compensation they seek."
