During an interview with ABC News’s Jonathan Karl, Republican Vice Presidential nominee J.D. Vance discussed a Minnesota law signed by Democratic Vice Presidential nominee Tim Walz. Vance claimed the law would "take my children away from me if I have different world views" than Democrats. Karl refuted this assertion, describing Vance's interpretation as "crazy."
A review of HF 146 reveals that the law grants Minnesota courts "temporary emergency jurisdiction" in cases where a child is brought to the state for "gender-affirming care." This provision allows an adult bringing a child to Minnesota for transgender drugs or surgeries to petition the court for custody, potentially overriding custody decisions made in the child's home state.
The law also prohibits state agencies from cooperating with custody orders from other states if those orders would remove a child from a parent or guardian who permits gender-affirming treatments. This could prevent reunification of children with parents who oppose such treatments.
Contrary to Karl’s statement, these provisions enable Minnesota officials to strip custody from parents who disagree with gender-affirming procedures, according to legal experts. The American Principles Project (APP) issued a travel advisory following the passage of this law last year.
APP President Terry Schilling criticized ABC News's coverage, stating:
“For years, public confidence in the legacy media has been declining, and it’s no secret why. Press outlets have become increasingly blatant in their propagandizing for Democrats, efforts which have come to include outright lying on behalf of candidates like Kamala Harris and Tim Walz. This Sunday’s whopper by ABC News’s Jonathan Karl is just the latest example.
“If the legacy media desire to win back the trust of Americans, they should apologize for their past propagation of misinformation as in this episode and instead commit themselves to covering the news in a non-partisan manner. Otherwise, all they will accomplish in their continued attempts to gaslight the public will be the complete destruction of their remaining credibility.”
