Louisiana files lawsuit against FDA over mail-order abortion drug policy

The State of Louisiana, represented by Attorney General Liz Murrill, and Rosalie Markezich, who describes herself as a survivor of abortion drug coercion, have filed a lawsuit against the U.S. Food and Drug Administration (FDA). The legal action seeks to overturn the federal mail-order policy for abortion drugs, arguing that it harms women and interferes with state-level pro-life laws.

Rosalie Markezich shared her experience with the mail-order system, stating: “Had the FDA required an in-person visit with a doctor before dispensing the drugs, my boyfriend would never [have] been able to obtain the drugs that he made me take … and I would have told the doctor that I wanted to keep my baby.” Authorities in Louisiana have issued an arrest warrant for a California-based doctor accused of sending abortion drugs to Markezich’s boyfriend.

Louisiana has recently enacted legislation known as the Catherine and Josephine Herring Act. This law makes it illegal to administer abortion drugs without consent. The act is named after Catherine Herring, a survivor of domestic violence who discussed her story during a call organized by Susan B. Anthony Pro-Life America.
