Former Kansas Secretary of State Kris Kobach (R) voiced his support for the Value Them Both amendment.
He said it's a key first step for the state to restore pro-life laws.
"Decisions about abortion policy are now in the hands of state legislators and voters, where they belong," Kobach said on Twitter. "We must pass the Value Them Both amendment on August 2. After that, as Kansas attorney general, I will quickly take action to fully restore our pro-life laws in Kansas."
Kobach is seeking the Republican nomination for attorney general, the Kansas Reflector reported.
The Supreme Court officially ruled in a 5-4 decision on June 24 to overturn Roe v. Wade, thereby returning power to the states to determine the legality of abortion, according to CNBC.
"The Constitution makes no reference to abortion, and no such right is implicitly protected by any constitutional provision, including the one on which the defenders of Roe and Casey now chiefly rely — the Due Process Clause of the Fourteenth Amendment," Justice Samuel Alito wrote in his majority opinion, as reported by CNBC. "... It is time to heed the Constitution and return the issue of abortion to the people's elected representatives."
The Kansas Supreme Court determined in the 2019 case Hodes & Nauser, MDs, PA, et al v. Derek Schmidt, et al that the Kansas Constitution protects a woman's right to undergo an abortion. The case was related to two physicians who perform abortions through dilation and evacuation, according to the Kansas Judicial Branch's website.
Dilation and evacuation is a form of abortion that is commonly used when a fetus is between 14 and 24 weeks old, the British Pregnancy Advisory Service said on its website. During the procedure, the woman's cervix is stretched with rods called dilators, and the fetus is removed from the uterus with tools and suction.
The method is not without occasional serious complications. In 1 in 800 dilation and evacuation procedures, the woman can experience hemorrhaging or discover that remnants of the fetus were left in her uterus. Less serious side effects include infections, psychological problems, damage to the cervix, unpredictable bleeding, a punctured uterus, or bladder damage.
The Value Them Both amendment to the Kansas constitution would allow elected lawmakers to pass laws regulating abortion and would state that government funding of abortion is not required.
